Kanye West’s Wont Have To Pay Backstreet Boys, Announces Release Date And Track-list For New Album ‘Vultures’ with Ty Dolla Sign

Kanye West ¥$ and Ty Dolla Sign going but the name ¥$ had a listening party for highly anticipated collaborative album, “Vultures” yesterday (December 11) at an electrifying event in Miami’s Wynwood Marketplace during Art Basel weekend ahead of the album’s December 15 release.

The duo, undeterred by the delays and technical glitches, finally took the stage after an unexpected two-and-a-half-hour wait caused by difficulties connecting West’s phone to the audio system. The Vultures Rave, initially promised to start at midnight, featured a diverse lineup of guest stars, including Chris Brown, Offset, Kodak Black, Lil Durk, Bump J, Freddie Gibbs, and even West’s daughter North.

Fans, both in attendance and watching online, were treated to a sneak peek of approximately 10 songs from the album, slated for release later in the week. The performance included memorable moments like North West showcasing her budding rap skills on “Slide” alongside her father and Ty. Ye rhymes on the song Vulture’s “Everybody want me to say the wrong thing okay Burger King.”

There is an interpolated element of Charlie Wilson’s recreated chorus on the track “Everybody.”

TMZ reported that the Backstreet Boys did not give Kanye permission for the song, but Ye’s incorporation of the Backstreet Boys’ 1997 hit, “Everybody (Backstreet’s Back),” as part of “Everybody” has some legal intricacies surrounding its usage.

Unlike a traditional sample, where permission from both the record label and the publisher is required, West’s approach involves an interpolation. In this case, the song features a recreated chorus performed Wilson. An interpolation essentially constitutes a cover of a segment of a song, entailing permission solely from the publisher.

The Backstreet Boys, as non-writers of the song, lack control over its use, as the credits are attributed to mega-hitmaker Max Martin and his late mentor, Denniz Pop. Consequently, the group holds no sway over the song’s utilization unless Martin or Pop’s estate chose to exercise their authority, which, as of now, appears not to be the case.

There’s also a possibility that, since the song has not been officially released or generating revenue, West could publicly play it without infringing copyright. This strategy, seen recently with David Guetta’s song featuring an AI-generated fake-Eminem verse, avoids legal issues until the song is formally released.

Kanye West severed ties with his longtime label, Def Jam, and publisher, Sony Music Publishing, in 2021 after the conclusion of his contracts and it is not clear which label the Yeezy designing will be distributing with.
